Streamside Protection Areas - beautiful but beware of the restrictions

Why have Streamside Protection Areas?

Federal and Provincial legislation requires local government to protect fisheries and their streamside habitat. Guidelines are in place to safeguard the areas and how development takes place.

Land effected?    

  • Any property on the North Shore that is within 15 metres (50 feet) of the top of bank of a stream OR

  •  Within 10 metres (33 feet) of the top of bank of a ravine more than 60 metres (200 feet) wide OR

  • Within 30 metres (100 feet) of a stream for properties greater than 0.5 hectares in size located adjacent to the Capilano River, Lynn Creek, Seymour River or Mackay Creek at any point south of Marine Drive.

What is involved if I want to build or renovate?

A topographic survey plan prepared by a BC Land Surveyor showing the top of bank of the stream, the applicable streamside setback areas and the proposed development location of your renovation or new home. A qualified environmental professional may be required to prepare a report identifying stream impacts and mitigating and/or compensation measures that may need to be taken. 

If I want to purchase a property with a stream nearby what should I do?

Contact a qualified environmental professional and a BC Land Surveyor who have knowledge and experience dealing with these issues. Local professionals are familiar with requirements and dealing with local municipal staff.   An Architect should be consulted in order to help in the design of a home that suits the topography and site context of the lot.
